abstract:

An organic vertical cavity laser light producing device (10) comprises a
substrate (20). A plurality of laser emitters (200) emits laser light in a
direction orthogonal to the substrate. Each laser emitter within the
plurality of laser emitters has a first lateral mode structure in a first
axis orthogonal to the laser light direction and has a second lateral mode
structure in a second axis orthogonal to both the laser light direction
and the first axis. Each laser emitter comprises a first mirror provided
on a top surface of the substrate (20) and is reflective to light over a
predetermined range of wavelengths. An organic active region (40) produces
laser light (350). A second mirror is provided above the organic active
region and is reflective to light over a predetermined range of
wavelengths. A pumping means excites the plurality of laser emitters.

SalesForce vs MS:反撃

反撃が始まった、。
しかもLinuxの守護神たる、Open Invention Network（OIN）を剣としている。
新しいフェーズになった。

　MSは訴訟の定石通り、まずは小さい城を落とそうとした。そこで判例を確保し、訴訟資金も生みだす。
たが思わぬ敵を引きずり出したのではないか？

　OINはLinuxの自衛組織だ。
加盟すれば訴えられた時の盾となってくれる。訴えた企業の特許を使っているのではなく、ＯＩＮの特許を使っているのだよ。とはねのけられる。

　ところが今回はOINを矛（剣）とした。
ＯＩＮから権利を譲り受けて逆に訴えたのだ。
攻撃は最大の防御。

調べてみるとＯＩＮを譲渡人とする特許はわずか４件しかない。渡した相手（譲受人）は全てSalesForce.com
特許を集め、盾として提供しているところが武器の提供をはじめた最初のケースではないか？

仕組んだのはこの「天敵」弁護士に違いあるまい。

　さて、実際の特許を見ていってみよう。
先の記事によると、武器として選んだのは５件の特許だ。
このうち１件は自社特許であり、他の１件はMINOR VENTURESというところから、２００７年１０月に入手している。そして残りの３件をＯＩＮから譲り受けている。（契約）時期は今年の５月初旬。特許庁への登録は６月だ。これら３件の特許は、
6813633　Dynamic multi-level cache manager
内容は、一言でいうと、「マルチCPU、ネットワーククライアントを想定したキャッシュ管理」だ。

6918059　Method and system for handling errors in a distributed computer system
同じく「クラウドにおけるエラー処理」

7024454　Work sharing and communicating in a web site system
同じく「サーバー分割の話。医療系を例示。」

どれも、今は普通に使っているんじゃないかと思えるものばかりだ。

いずれも技術起源は２０００年前後だ。
シリコンバレーでネットバブルがはじける直前だ。

ここで、Ｗｉｋｉでネットバブルについて復習しておこう。

インターネット・バブル
「インターネット・バブル（Internet Bubble）とは、1990年代末期に、アメリカ合衆国の市場を中心に起った、インターネット関連企業の実需投資や株式投資の異常な高潮である。「ドットコム会社」と呼ばれる多くのIT関連ベンチャーが設立され、1999年から2000年にかけて株価が異常に上昇したが、2001年にかけてバブルははじけた。」とのことだ。

　バブルの真っ只中で多くのエンジニアは、夢をみた。それを特許の形で後世に残した。そして、今、子孫たる企業を助けている。
不思議なめぐりあわせだ。

　さて、ＯＩＮがSalesForceに譲り渡した特許は４件だ。
ところが、訴訟に使われているものは３件。
そう、もうひとつ隠しだまがあるようなのだ。
7251745　Transparent TCP connection failover
がそれだ。クレーム数１１６。クラウド時のエラー処理に関しての特許だ。それも、かなり下層レベルでの処理を行っている話だ。図面も多く力強さを感じる。ただ、こういう表に出ない部分の話では侵害していると言うには、証拠集めが大変なのかもしれない。だから反訴には間に合わなかったのか？。
　また、この特許にはGovernment has certain rights in this invention. との記述がある。国に権利の一部があるようだ。それで、訴訟リストからはずしたのか？　だが、他の３件と合わせて譲り受けたのはなぜなのだろう？。権利関係を明確にすれば、強力な武器になるという判断があったのかもしれない。いずれにせよ、今後の要注意特許だ。

　さて、MSの次の手は何になるのだろう？
悪役になる覚悟をして、他の複数の企業を訴えるのも手だろう。
OINが守護神だとしても、剣の数には限りがある。
反訴のために（一時的にせよ）、譲り渡せる特許には限りがある。
一社に渡してしまったら、他には渡せない。他の企業は同じ特許を使って反訴はできない。その会社に処分権限がある排他的権利である特許権だからこそ、それを使って訴え（反訴）を起こすことができるからだ。
　そうすれば、何が起こるのだろうか？
MSに訴えられた企業群が一時的にせよ、部分的にせよ、「経営統合」を行い、まとまって、「反訴」に出るかもしれない。
もしくは、（気質的に）考えにくいが、全てMSが飲み込む。
激動の予兆だ。

displays include a scheme for rear-addressing displays, which allows for
in-plane switching of the display material. Other schemes include a

structure that facilitates manufacture and control of a color display.
Another electrode structure facilitates addressing a display using an
